These are the Booking Conditions that apply to all holidays and stays booked with Nomad Island and should therefore be read carefully. Should any part of these conditions become invalid or unenforceable, this will not affect the validity of the remainder of these conditions.
Booking conditions
Your contract is done with Abenteuer Albanien SH.P.K., known as Nomad Island for commercial purposes. The person signing the booking form must read and accept these Booking Conditions. At the time of booking or at check-in, we will take your credit/debit card details, and you authorize the use of this card for any sums that become owing to us. We also have the right to require full payment in advance or a deposit at the time of booking in certain circumstances or if the booking includes the supply of certain items or services. No Booking shall be treated as confirmed until the details and/or payment/deposit described in this paragraph have been provided. We reserve the right to refuse to accept bookings at our absolute discretion. Please inform us immediately if there are any discrepancies in the costs or details of your booking. A minimum length of stay, deposit, cancellation charge and other conditions may apply to certain rates. Price lists for additional items are available on request.
Pricing
Upon making your booking, the price of your stay will not normally be subject to change, however, we reserve the right to increase or decrease prices.
Nomad Island reserves the right to require a 25-50% deposit of the total holiday cost when pre-booking as a deposit to secure a spot. The remainder of the booking will be paid at the check-in date. Your stay may be paid in cash in EUR or LEK. Credit or Debit Card payments will incur a 4% transaction fee.
If the guest doesn’t pay for the stay upon check-in, the booking will be cancelled and the deposit will not be returned. Nomad Island has the right to cancel a person’s place on the course if full payment is not received punctually.
Cancellation policy
- If the guest cancels more than four weeks before the arrival date, 100% of the deposit will be refunded.
- If the guest cancels within four to two weeks before the arrival date, the deposit is non-refundable. If the original booking is modified and shortened less than two weeks before arrival, cancelled days will be charged.
- If the guest cancels less than two weeks before the arrival date, full payment of the booking will be required. If the guest arrives and decides to leave earlier than scheduled, in the case of a no-show or cancels the booking after the arrival date, full payment will be required as well.
Please note, depending on your payment method refunds may incur a 4% processing fee and/or changing currency exchange rates.
Other
Guests may be required to confirm their identity by providing their booking reference; their passport/identity card/driving licence and a valid credit or debit card which will be swiped in the presence of the cardholder.
The information above may be requested for each member of your party over the age of 16, and we reserve the right to refuse entry to persons who cannot provide the information set out above.
Your booking is for a class of room and does not guarantee that you will be able to stay in a specific room or in the same room for the duration of your stay. If you have indicated a preference for a particular room with your reservation, we will use our reasonable efforts to honour this preference. However, we may need to allocate an alternative room to you for operational or safety reasons. If we need to move you to a different room during your booking for which a lower rate is available than the rate you booked at, we will refund you the difference in the rates.
Nomad Island reserves the right to refuse to further accommodate hosts behaving irresponsibly, and contractual obligations will be terminated. The guilty party will be liable for the cost of any damage caused. Where this is the case shall have no obligation to refund you for lost accommodation, other services or any other loss or expense incurred.
Bike rental at Nomad Island is free for guests. In case of damage, loss or theft of the bike, the amount of the bike costs will be charged to the guests responsible for the bike during that period of time.
Nomad Island accepts no responsibility for loss, theft or damage to persons or property during their stay. We reserve the right, and you hereby authorize us, to charge your credit or debit card for any damage incurred to your room or the building during your stay (including without limitation specialist cleaning) or for any items that are missing when you leave.
At certain times, facilities may become unavailable due to maintenance, adverse weather conditions or other reasons beyond our control. We will attempt to keep all guests informed of these circumstances, however, this may not always be possible.
Guests are not permitted to smoke in rooms or inside the house.
The company accepts no liability and will not pay any compensation where the performance of its obligations is prevented or affected directly or indirectly by or as a result of force majeure or any circumstances beyond its reasonable control including, but not limited to, flood, earthquake, extreme adverse weather conditions, natural disasters, acts of terrorism, fire or failure of electric power, interruption or malfunctioning internet connection, gas, water, or other utility services, plant machinery, computers, vehicles or any collapse of building structures.
Nothing contained in the contract or in any other document referred to or incorporated in it shall be read or construed as excluding any liability for death or personal injury caused by the company’s negligence or liability for fraud or fraudulent misrepresentation.
The contract and any non-contractual obligations arising in connection with it are governed by Albanian law. Each party irrevocably waives any objection which it may now or later have to proceedings being brought in the Albanian courts in Tirana, Albania.
Room type. You acknowledge that you are booking a room/bed by type, not a specific unit. Following the booking, Nomad Island will place you in a specific unit based on information gathered in the booking process. Once in residence, Nomad Island reserves the right to reassign you to a different unit should they deem it necessary or appropriate, solely at Nomad Island’s discretion.

Coworking Service Agreement T&Cs
The services Nomad Island provides to you are subject to the following Terms and Conditions (T&C). Nomad Island reserves the right to update the T&C at any time without notice to you. Nomad Island community pass application does not create a tenancy but a prepaid usage licence to use the provided amenities on a biweekly, monthly or casual basis.
Description Of Services
Nomad Island may provide you with access to your room, office space, workstations, internet access, office equipment, knowledge resources, and other services (collectively, “Services”). The Services at all times are subject to the T&C.
Any items of common use (e.g. microwave, iron, kettle, induction top, magazines, crockery, common TV units, etc) provided by Nomad Island as part of the amenities package, shall be used only in the common areas and not in individual rooms.
No furniture or furnishings in the common areas of the house may be moved by the residents at any point of time.
Any damage to the house must be reported by the residents immediately to a Nomad Island representative. The residents will be liable to pay for the expenses or costs arising from use/misuse of the same by the resident, except for damages caused by normal wear and tear.
Residents must keep the keys to their rooms and wardrobes safe with them. In case of loss, they will have to bear the cost of replacing keys. The locks for the wardrobes and/or the room are not allowed to be changed.
No Unlawful Or Prohibited Use
You will not use the Services for any purpose that is unlawful or prohibited by these terms, conditions and notices. You may not use the Services in any manner that could damage, disable, overburden, or impair any Nomad Island’s server, or interfere with any other party’s use and enjoyment of any Services.
You may not attempt to gain unauthorized access to any Services, or accounts, computer systems or networks connected to any Nomad Island server or to any of the Services, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Services, nor should you post or download files that you know or should know are illegal or that you have no rights to.
You hereby represent and warrant that you have all requisite legal power and authority to enter into and abide by the terms and conditions of this T&C and no further authorization or approval is necessary. You further represent and warrant that your participation or use of the Services will not conflict with or result in any breach of any license, contract, agreement or other instrument or obligation to which you are a party.
Use Of Services
You agree that when participating in or using the Services, you will not:

Defame, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others;

Use any material or information, including images or photographs, which are made available through the services in any manner that infringes any copyright, trademark, patent, trade secret, or another proprietary right of any party; Upload files that contain viruses, Trojan Horses, Worms, time bombs, candle-bots, corrupted files, or any other similar software or programs that may damage the operation of another computer or property of another coworker.
Download any file that you know, or reasonably should know, cannot be legally reproduced, displayed, performed, and or/distributed in such a manner.
Restrict or inhibit any other user from using and enjoying the Services.
Violate any code of conduct or other guidelines which may be applicable for any particular Service (including the Building Rules).
Harvest or otherwise collect information about other, including email addresses, without the authorization or consent of the disclosing party.
Violate any applicable laws or regulations; or
Create false identity for the purpose of misleading others.
Terminations
The T&C must be adhered to at all times. Failure to follow T&C can result in non-renewal or even early termination of the usage licence. Nomad Island reserves the right to terminate any Service at any time, immediately and without notice, if you fail to comply with the T&C. This includes non-payment or violation of the space rules. If this happens, Nomad Island will refund any amounts paid for unused periods that remain after deducting any pending charges, on a prorated basis.
Confidentiality
You acknowledge and agree that during your participation in and use of the Services, you may be exposed to Confidential Information. “Confidential Information” shall mean all information, in whole or in part, that is disclosed by Nomad Island or any participant or user of the Services or any employee affiliate, or agent thereof, that is non-public, confidential or proprietary in nature. Confidential information also includes, without limitation, information about the business, sales, operations, know-how, trade secrets, business affairs, and any knowledge gained through examination or observation of or access to the facilities, computer systems and/or books and records of Nomad Island, any analyses, compilations, studies or other documents prepared by Nomad Island or otherwise derived in any manner from the Confidential Information that you are obliged to keep confidential or know or has reason to know should be treated as confidential.
Your participation in and/or use of the Services obligates you to
Maintain all Confidential Information in strict confidence;
Not to disclose Confidential Information to any third parties;
Not to sue the Confidential Information in any way directly or indirectly determined to Nomad Island or any participant or user of the Services.
All confidential information remains the sole and exclusive property of Nomad Island or the respective disclosing party. You acknowledge and agree that nothing in this T&C or your participation or use of the Services will be construed as granting any rights to you, by licence or otherwise, in or to any Confidential Information or any patent, copyright or other intellectual property proprietary rights of Nomad Island or any participant or user of the Services.
Participation In Or Use Of Services
You acknowledge that you are participating in or using the Services at your own free will and decision. You acknowledge that Nomad Island does not have any liability with respect to your access, participation in, use of the Services, or any loss of information resulting from such participation or use.
Disclaimer Of Warranties
To the maximum extent permitted by the applicable law, Nomad Island provides the Services “as is” and with all faults, and hereby disclaims with respect to the services all warranties and conditions, whether express, implied or statutory, including but not limited to: merchantability, fitness for a particular purpose, lack of viruses, accuracy or completeness of responses, results, workmanlike effort and lack of negligence. Also, there is no warranty, duty or condition of title, quiet enjoyment, quiet possession, correspondence to description or non-infringement. The entire risk as to the quality, or arising out of participation in or the use of the services, remains with you.
Exclusion Of Incidental, Consequential And Certain Other Damages
To the maximum extent permitted by the applicable law, in no event shall Nomad Island or its subsidiaries (whether or not wholly-owned), affiliates, divisions, and their past, present and future officers, agents, shareholders, members, representatives, employees, successors and assigns, jointly and individually be liable for any direct, special, incidental, indirect, punitive, consequential or other damages whatsoever (including, but not limited to damages for: loss of profits, loss of confidential or other information, business interruption, personal injury, loss of privacy, failure to meet any duty (including of good faith or of reasonable care, negligence, and any other pecuniary or other loss whatsoever) arising out of or in any way related to the participation in or inability to participate in or use of the services, the provision of or failure to provide services, or otherwise under or in connection with any provision of this agreement, even in the event of the fault, tort (including negligence), strict liability, breach of contract or breach of warranty of Nomad Island, and even if Nomad Island has been advised of the possibility of such damages.
Limitation Of Liability And Remedies
Notwithstanding any damages that you might incur for any reason whatsoever (including, without limitation, all damages referenced above and all direct or general damages), the entire liability of Nomad Island or its subsidiaries (whether or not wholly-owned), affiliates, divisions, and their past, present and future officers, agents, shareholders, members, representatives, employees, successors and assigns under any provision of this T&C and your exclusive remedy for all of the foregoing shall be limited to actual damages incurred by you based on reasonable reliance up to 1000 EUR. The foregoing limitations, exclusions and disclaimers, including the previous sections) shall apply to the maximum extent permitted by applicable law, even if any remedy fails its essential purpose.
Non-Disparagement
You shall, during and after the participation in and use of the Services, refrain from making any statements or comments of a defamatory or disparaging nature to any third party regarding Nomad Island, or any of Nomad Island officers, directors, employees, personnel, agents, policies, services or products, other than to comply with law.
Indemnification
You release, and hereby agree to indemnify, defend and save harmless Nomad Island and Nomad Island subsidiaries (whether or not wholly-owned), affiliates, divisions, and their past, present and future officers, agents, shareholders, members, representatives, employees, successors and assigns, jointly and individually, from and against all claims, liabilities, losses, damages, costs, expenses, judgments, fines and penalties based upon or arising out of your negligent actions, errors and omissions, wilful misconduct and fraud in connection with the participation in or use of the Services. You further agree in the event that you bring a claim or lawsuit in violation of this agreement, you shall be liable for any attorney fees and costs incurred by Nomad Island or its respective officers and agents in connection with the defence of such claim or lawsuit.
Sever-Ability
In the event that any provision or portion of this T&C is determined to be invalid, illegal or unenforceable for any reason, in whole or in part, the remaining provisions of this T&C shall be unaffected thereby and shall remain in full force and effect to the fullest extent permitted by applicable law.
